A 1/3 deposit is due upon reservation. Final balance payments are due no later than 30 days prior to check-in. We accept checks and all major credit cards. For reservations made within 30 days of check-in, full balance is due with reservation. Reservations are not finalized until the deposit is received and you electronically sign and submit the rental agreement. POLICIES
Check-in Time: 3 p.m. or later / Check-out Time: by 10 a.m.
Onsite Parking: 1 car (additional cars may be parked on the street or in municipal parking areas; extra cars on the lot will be towed at owner's expense)
Calling card must be used for all long distance calls at Bradley on the Bay.
Balance is due by 30 days prior to check-in.
TERMS & CONDITIONS
GENERAL TERMS - Owners of the unit shall provide lodging at the premises, for the term and at the rate specified below. Check-in time is 3 p.m. unless otherwise stated in writing from the owners. Check-out time is 10 a.m. unless otherwise stated in writing from the owners. Keys shall be picked up from and returned to the onsite lockbox. Lockbox code and instructions will be provided upon receipt of final payment. The unit is professionally cleaned between tenants and cleaning may not be completed until 6 p.m. on the day of arrival, although we make every effort to have it completed before 3 p.m. Guest is solely responsible for the unit as is upon check-in. Guest may not reenter the premises after check-out for any reason without the express content of the Owners or Owners' Agent. Guest shall vacate the premises at the end of the term unless requested to vacate sooner due to violation of restrictions set forth in this agreement. Owners' or Owners' Agent may enter the property for repair or inspection at any reasonable time. Upon vacating property, Guest must lock all windows and doors. GUEST IS LIABLE FOR ANY THEFT OR DAMAGE RESULTING FROM THE GUESTS' FAILURE TO DO SO. Reservation does not take effect until both deposit (or balance in full if within 30 days of check-in) and electronically signed agreement are received by Owners. Returned check fee is $25 (this includes electronic checks). Guests must provide their own linens, toiletries, and paper products.
PETS - Well-behaved pets may be allowed at Diamond Bay only. Generally, dogs, cats, and birds are allowable pets. No reptiles or rodents of any kind permitted. Guests are responsible for cleaning up after their pets both inside and outside of the condo.
SECURITY DEPOSIT/DAMAGE PROTECTION POLICY - The property shall be vacated at the end of the rental term in as good order and condition as the property was in at the start of the term, barring reasonable wear and tear. Guest shall be liable for any and all damage or theft to the premises or any property therein during the rental term. Upon occupancy, Guest must give Owners or Owners' Agent a list of existing damage in the property to avoid responsibility for this damage. Guests shall pay for a Damage Protection Policy as shown below. This premium is non-refundable, except in the event of reservation cancellation in accordance with the policies of the third-party administering the policy.
CANCELLATION POLICY - If Guest fails to pay the final balance due by the due date, Owners may make the rental term available to other Guests, without liability and at Owners' discretion. In such instance, Guest forfeits all funds held by the Owners. Any cancellation within forty-five days of check-in or in conjunction with a promotional rate (or "special") must be re-booked for the entire term originally reserved by Guest and at the same or greater rate in order to receive a refund; in such case, all funds less a $10 processing fee will be returned. For partial re-booking, refunds will be prorated accordingly. If unit is not re-booked, all funds in the possession of the Owners are forfeited by the Guest. In the case of cancellation less than forty-five days or in conjunction with a promotional rate, as an alternative to forfeiture, Guest may select another rental term of equal or greater value within the same calendar year; funds held will be applied to the new reservation, but promotional rate may not be honored. For cancellations greater than forty-five days from check-in and not in conjunction with a special, all funds will be returned to Guest. Terms of agreement are in effect upon receipt of deposit and signed agreement. Owners reserve the right to cancel this agreement for good cause at any time, in which event Owners' liability, if any, shall be limited to funds received from Guest. Owners shall not be liable for any mechanical failures in the premises or appliances therein during the occupancy term; however, Owners or Owners' Agent shall take reasonable action to correct such failures. Partial refunds for mechanical failures are at the sole discretion of the Owners, and are not required. Basic cable TV service provides channels 2-13. Phone and cable service are not guaranteed. Guest's misrepresentation of any fact in this agreement shall entitle Owners to cancel the agreement and retain all funds. No refunds will be given for inclement weather including hurricanes, or for shortened stays for any reason.
RULES & RESTRICTIONS - The property must be occupied by the Reserving Guest identified below, and all occupants of the property shall be supervised by the Reserving Guest. The Guest who electronically signs this rental agreement must be a financially responsible adult. Occupancy shall not exceed the maximum occupancy identified by Owners. The number of vehicles on the parking lot shall not exceed the maximum identified in this agreement. If a parking pass is required, the pass must be displayed in the windshield of the vehicle at all times on the lot in order to avoid towing. Owners are not responsible for any towing costs incurred by Guests. The property shall be used for residential purposes only. No animals of any type shall be kept or permitted in the property unless expressly authorized elsewhere in this agreement. Occupants shall obey all state, county, and municipal laws, ordinances, and regulations. Occupants shall obey all condo community rules and regulations. Occupants shall not cause or allow activities on the premises to disturb neighbors. All appliances and other items in the property shall be used carefully and for legitimate purposes only. No alterations, additions, or changes to the property shall be made. No barbecue or other open-fire cooking is permitted on the property, including balconies/decks. No oversized vehicles on premises. Trailers are prohibited except in the Bradley on the Bay property where trailers up to twenty feet in length are permitted in the unit's parking space. Neither Owners nor Owners' Agent have control or jurisdiction over any amenity, property, or service not contained within the unit, such as, but not limited to, parking, pool, and trash. Amenities are not guaranteed. Guests shall not cause or allow loud or excessive noise, music, or other sounds to be made in the premises. Ocean City has adopted a Noise Control Ordinance that makes it unlawful to cause or permit noise levels which exceed those established by the Department of Health and Mental Hygiene of the State of Maryland (COMAR 10.20.01). Upon notification that these noise levels have been exceeded as a result of activity on the premises, Guest may be ordered to vacate the premises. This property is a NON-SMOKING unit; failure to comply with this rule will result in an immediate order to vacate and assessment of damage charges. If excessive noise or other inappropriate activity results in a citation from the police, guests will be ordered to vacate immediately with no refund, and will also be charged a fine of $200.
ORDER TO VACATE - Guest and all other occupants shall vacate the property promptly upon order of Owners or Owners' Agent. All occupants who refuse to vacate the property at the end of the rental term or upon demand of Owners or Owners' Agent shall be considered trespassers and subject to arrest and prosecution as such. Occupants who remain in the property beyond the check-out time shall pay Owners $35 for the first hour (or portion thereof) and $50 per hour for each additional hour (or portion thereof) beyond check-out time, unless otherwise specified elsewhere in this agreement. Occupant's belongings left in the property after the property is vacated may be disposed of by the Owners or Owners' Agent without liability. Owners and Owners' Agent are not responsible for theft.
LEGAL ACTION - If Guest breaches this agreement, Guest shall be obligated to reimburse Owners and/or Owners' Agent for all costs, including reasonable attorney's fees, of all action reasonably necessary to protect the Owners' or Owners' Agent's interests hereunder. The parties agree that any litigation involving this agreement or Guest's occupancy of the property may be maintained in Worcester County, Maryland, and Guest waives any venue objection he may otherwise have.
FUNDS - Owner shall not be obligated to deposit any funds in a trust, escrow, or other special account, and Owners shall not be obligated to pay Guest interest on any funds received or refunded.
INDEMNITY - Guest shall indemnify Owners and Owners' Agent and hold them harmless on account of property damage, personal injury, or other financial loss, caused by Guest or other occupants of the property. Owners' and Owners' Agent's liability is limited to gross negligence.
OWNERS' AGENT - Owners' Agent is anyone identified as working on behalf of Owners, pursuant to the execution and enforcement of this agreement. Upon Agent, Owners confer all authority granted by this agreement and subject to any other agreement held between Owners and Agent. Owners' Agent includes but is not necessarily limited to Owners' cleaning contractor.
AGREEMENT - This agreement constitutes the entire agreement and no other oral, implied, or inferred representations, agreements, or promises have been made by Owners or owners' Agent unless expressly stated herein.
By electronically signing this Rental Agreement and clicking Submit, you are signifying that you agree to all terms and conditions of the Rental Agreement as described herein. You further agree and represent that you are a financially responsible adult with an established credit history.
